Privacy policy for data processing in connection with the issue of an additional fee

1. Processed data and purpose

The data you provide during the inspection (e.g. name, address, date of birth, ID data), observations made by inspectors during or about the inspection (e.g., behaviours, descriptions of persons), and correspondence with you regarding an additional fee will be processed by Wiener Linien GmbH & Co KG for the purpose of handling the additional fee and enforcing and, if necessary, defending legal claims. In some cases, it is necessary to retrieve your address from the Central Register of Residents. Data from legal guardians is collected from passengers who are minors.
No automated decision-making, including profiling, takes place in the context of the processing in question.

2. Data transmission

In the event of non-payment, your data will be transferred to a debt collection agency, which will subsequently take over the collection of the outstanding debt. Further legal collection steps are possible and in this case data will be transferred to an authorised lawyer and subsequently to a competent court.
Furthermore, your data may be transmitted to the competent administrative penal authority on the basis of Article III (1) (2) of the Introductory Act to the Administrative Procedure Acts 2008.

3. Legal basis

Your personal data is processed on the basis of the legitimate interest of Wiener Linien (Art. 6 (1) (f) GDPR), as we need it to process the additional charge and to enforce and, if necessary, defend legal claims, as well as in the context of fulfilling the contract of carriage (Art. 6 (1) (b) GDPR). In addition, we process your personal data to comply with legal retention obligations (Art. 6 (1) (c) GDPR).

4. Deletion/Retention period

In principle, your personal data will be stored for as long as is necessary to fulfil the respective purpose and, in addition, for as long as statutory retention obligations exist or retention is necessary for the assertion, exercise or defence of legal claims.
Due to retention requirements for tax relevant records, data in connection with the inspection and the payment will be deleted after 7 years pursuant § 212 Austrian Commercial Code. This period starts upon expiry of the calendar year in that a payment was made or a document change occurs.

6. Your rights

You have the right to information, correction of your data, deletion under certain conditions, digital data transfer and restriction of processing. You have the right to object to the processing of your data. If data processing by Wiener Linien is based on consent, you can withdraw this consent at any time.

Furthermore, you have the right to lodge a complaint with the Austrian data protection authority, which you can make use of in the event of data protection violations.
